General conditions

Please note that a tour will be cancelled if there are less than 20 participants for that tour

Below conditions are applicable on all agreements which are made with Holland Tour Guides. Deviations concerning these conditions are only binding, if they have been confirmed in written by the board of Holland Tour Guides. The invalidity of one or several conditions doesn’t affect the validity and application of the other conditions.

Definitions:

Organizer: Holland Tour Guides
Customer: the (legal) person who requested the organizer to accomplish activities. The customer is also called the principal.

The participant agrees with the information and conditions of Holland Tour Guides as described below, when he signs the order confirmation:

Definitions:

1.1. An agreement is realized if the customer places an reservation order with the organizer (in written) for the program they choose.

The organizer will send a written confirmation to the customer (order confirmation) by E-Mail (or by mail/fax).

1.2. The receipt day is the day on which the agreement was realized.

1.3. The person who enters the agreement on behalf of or for the benefit of the group is severally liable for all obligations which result from this agreement.

Article 2: Payment:

2.1. In case of a registration concerning an activity for the total amount due must have been completely transferred to Holland Tour Guides, unless otherwise agreed (in written).

2.2. In case the amount hasn’t been paid in time (at least 7 days before the tour) the organizer has the right to cancel the booked activity. Amounts which have already been paid will not be paid back in such a case; the cancellation conditions in article 5 of these conditions remain in full force.

2.3. The customer who doesn’t pay in time is legally in default; Holland Tour Guides doesn’t require a further proof of default for it. Holland Tour Guides has the right to dissolve the agreement or to demand complete fulfillment together with an additional compensation for all costs which have been made for the benefit of the agreement and for all additional costs of for example a process server / debt-recovery agency.

2.4. The customer who doesn’t pay in time also owes Holland Tour Guides the legal interest over the total amount plus costs as from the omission day (a part of the month is invoiced as a whole month) and costs of third parties.

Article 3. Costs/Sum

3.1. The price includes all the things which are mentioned in the activity.

3.2. Not included in the price/sum:

a. The costs for travel luggage, travel accidents, medical expenses and cancellation insurance. b. Possible costs for extra drinks/food and extra materials which have been used.

3.3. The costs mentioned under 3.2. B. are settled by the customer with the concerning supplier on the day on which the activity takes place, unless otherwise agreed.

3.4. The published prices are based on the prices and conditions as they were known when the program was developed. Organizer Holland Tour Guides reserves the right to, prior to a reservation, change the price if it appears to be necessary due to price increases of third parties, under which the relevant VAT regulations.

Article 4. Change(s) by the customer

4.1. Changes by the customer must take place in written and provided with a date. The date of receipt is the date of change.

4.2. The customer should consider the program costs as known with Holland Tour Guides when the reservation is made.

4.3. If more participants are present at the activity (activities) than planned by means of the reservation, an additional collection will follow.

4.4. An increase in the number of participants in the agreed program by the customer can be dealt with, if possible.

Article 5. Cancellation by the customer

5.1. Cancellation(s) by the customer must take place in writing, provided with a date. The date of receipt is the date of change.

5.2. If a booking is cancelled, or changed, the following amounts will be charged per booking, unless otherwise agreed.

5.3. After realization of the agreement as described in article 1.1. the customer has to pay the following percentages of the complete invoice amount in case of cancellation:

Over 8 weeks before the agreed realization date of the agreement: 10 %
8-4 weeks before the agreed realization date of the agreement: 20 %
4-2 weeks before the agreed realization date of the agreement: 33 %
2-1 weeks before the agreed realization date of the agreement: 50 %
7-2 days before the agreed realization date of the agreement: 75 %
Within 48 hours before the agreed realization date of the agreement: 100 %

Article 6. Change(s) / Cancellation by the organizer

6.1. If Holland Tour Guides decides, due to circumstances resulting from the own management, to cancel the program or to change it, Holland Tour Guides is obligated to inform the customer as soon as possible.

6.2. Should an activity unexpectedly not take place, Holland Tour Guides is obligated to pay back the reservation sum which has (partially or completely) already been paid immediately.

Article 7. Damage by participant(s)

7.1. The participant who causes and/or gives or might give such trouble or problems that he/she strongly hampers the realization of the activity (event, workshop, arrangement, diner, guided tour etc) can be excluded from the (continuation of) the activity by the guide/companion of Holland Tour Guides.

7.2. All costs which result from hindrance and the exclusion of the participant are at the expense of the participant, if and as far as the consequences of hindrance and trouble can be imputed to him. Holland Tour Guides reserves the right to recover the possible damage caused by the participant.

Article 8: Complaints

8.1. Despite of the effort and attention it might be possible that a customer has a complaint. This complaint should be passed to the contact person/guide immediately so that the complaint or imperfection can be solved according to the customer’s satisfaction as good as possible.

8.2. If it isn't possible to solve the complaint during the activity, the office employees will deal with the complaint upon written filing.

Article 9: Publications

9.1. Holland Tour Guides doesn't accept any liability for information, photos, brochures and other publication material which are published by third parties.

9.2. Misprints and/or evident mistakes in the publication of or in behalf of the organizer don’t bind the organizer. The offer made by the organizer in publications is without engagement and can be revoked if it has to.

Article 10. Liability organizer

10.1. If the participant suffers damage in whatever way due to death, physical or mental injury, accidents, hurting, loss or theft and material loss caused to the participant (s) during or resulting from the activity (activities), the organizer cannot be hold liable, unless Holland Tour Guides is to blame for it.

10.2. The organizer cannot be hold liable for damage suffered from participants due to delays, mechanical troubles, weather conditions, nature influences, strikes, illness or whatever circumstances beyond one’s control.

10.3. The organizer cannot be hold responsible for actions and influences of third parties who aren’t directly involved in the realization of the agreement; circumstances which cannot be blamed to Holland Tour Guides and which, according to Dutch law or to the norms which are applicable in society, cannot (in fairness) be imputed to Holland Tour Guides.

Article 11. Force majeure

11.1. In case of force majeure Holland Tour Guides has the right to postpone the realization of the agreement or to dissolve it partially or completely, without having to pay compensation, costs or interest to the customer. The organizer will immediately inform the customer concerning each force majeure case and will try to offer an alternative, which satisfies both parties.

11.2. Force majeure: strikes, death, fire, transport, blocking, molestation, illness and in general all unforeseen circumstances due to which the performance of the agreement cannot be required from the organizer anymore.

11.3. Holland Tour Guides will try to execute each service at best and has the right to involve a third party in the execution of a service.

Article 12. Applicable law

12.1. Dutch law is applicable to the activities of the organizer. All disputes, also the disputes which are considered as such by only one of the parties, which result from an agreement entered with Holland Tour Guides, can only be tried by the authorized Judge, according to the rules of the absolute competence, unless Holland Tour Guides and the participant have agreed to solve it between themselves or to submit the dispute to an arbitration instance.
